Consumer Health Data Privacy Policy

FITAMP is a service of Arcanium - AI Solutions, registered with the Dutch Chamber of Commerce under number 42143166, postal address Keurenplein 41 Box D6991, 1069CD Amsterdam. This policy applies to residents of the United States, and in particular to consumers protected by Washington's My Health My Data Act, Nevada's consumer health data law (SB 370) and Connecticut's consumer health data rules. It adds to our privacy policy, which describes all the personal data FITAMP processes.
1. The consumer health data we collect
- Your age, gender, height, weight and body-fat percentage.
- Your 1RMs (bench press, squat, deadlift, overhead press) and your training experience.
- Anything you write yourself about injuries, limitations and goals.
- Your training: programmes, workouts, sessions, sets, weights and reps.
- Your conversations with the AI coach and the notes it keeps about you, which may contain health information you tell it.
2. Why we collect it and how we use it
Only to provide FITAMP to you: to build your training programmes, suggest weights, track your progress and let the AI coach guide you. We do not use it for advertising, we do not sell it, and we do not use it to make decisions about you outside the app.
3. Where it comes from
From you: what you enter in the app or on the website and what you tell the coach. From the app itself: what it calculates from your training, such as your progress and suggested weights. If you sign in with Google, Google gives us your name, email address and account ID; that is not health data.
4. Your consent
We collect and use your consumer health data only with your consent, which you give when you create your account by ticking the health-data box. You can withdraw it at any time on your profile page; we then erase your health data.
5. Who we share it with
We do not sell consumer health data and do not share it with third parties for their own use. Two kinds of processors handle it on our behalf, only on our instructions:
- Mistral AI (France), the AI provider behind the coach. It receives your profile and training context and your chat messages so the coach can answer.
- Our hosting providers, which run our servers in Germany, where the data is stored, and keep encrypted backups of it.
RevenueCat, which manages FITAMP Pro subscriptions, and Google Play, which handles payment, receive no consumer health data. We have no affiliates that receive it. We would disclose it otherwise only where the law requires us to.
6. Your rights
- Know and access: download all your data, including your consumer health data, from your profile page. You can also ask us by email which third parties and processors received it.
- Withdraw consent: on your profile page, at any time.
- Delete: erase your health data or delete your whole account on your profile page.
- Appeal: if we decline a request, you can appeal by emailing us with "Appeal" in the subject. We answer within 45 days. If you are not satisfied with the outcome, you can contact the Attorney General of your state.
We answer requests within 45 days, free of charge, and never treat you differently for using these rights.
